Algemene voorwaarden

Refinavision SL wordt in deze voorwaarden verder aangeduid als “Refinavisión”.

2. Toepasselijkheid

Deze algemene voorwaarden zijn van toepassing op alle offertes, reservaties, boekingen, verblijven en diensten aangeboden door Refinavisión.

Door het maken van een reservatie, het aanvaarden van een offerte of het gebruik van onze diensten verklaart de klant zich akkoord met deze voorwaarden.

Afwijkingen van deze voorwaarden zijn enkel geldig indien schriftelijk overeengekomen.

3. Aanbod en reservatie

Alle offertes van Refinavisión zijn vrijblijvend en gebaseerd op de op dat moment beschikbare informatie.

Een overeenkomst komt tot stand op het moment dat:

• de offerte schriftelijk wordt bevestigd door de klant, én
• de eventuele aanbetaling zoals vermeld in de offerte werd ontvangen

Refinavisión behoudt zich het recht voor om een aanvraag te weigeren zonder opgave van reden.

4. Prijzen

Alle vermelde prijzen zijn:

• exclusief of inclusief btw zoals aangegeven
• gebaseerd op de op dat moment geldende kosten

Refinavisión behoudt zich het recht voor prijzen aan te passen indien externe factoren (zoals energie, leveranciers, inflatie of wetgeving) dit noodzakelijk maken.

5. Betaling

Tenzij anders overeengekomen:

• Een aanbetaling van 50% is vereist bij bevestiging van de boeking
• Het saldo dient betaald te worden 30 dagen vóór aanvang van het verblijf of programma

Facturen dienen betaald te worden binnen de vermelde termijn. Bij niet-tijdige betaling behoudt Refinavisión zich het recht voor om de reservatie te annuleren.

Aanvullende kosten

Eventuele bijkomende kosten tijdens het verblijf of programma (zoals extra consumpties, activiteiten of diensten) worden afzonderlijk gefactureerd na afloop, tenzij anders overeengekomen.

6. Annulatie en wijzigingen

Annulatie door de klant

Annulatie van een bevestigde reservatie dient schriftelijk te gebeuren

Bij annulatie van een bevestigde reservatie gelden volgende voorwaarden (tenzij anders overeengekomen):

• Annulatie tot 30 dagen vóór aankomst: 50% restitutie van de aanbetaling
• Annulatie tussen 30 en 15 dagen: 50% restitutie van betaalde bedrag
• Annulatie minder dan 15 dagen vóór aankomst: geen restitutie

Wijzigingen

Wijzigingen in reservaties zijn mogelijk op aanvraag en afhankelijk van beschikbaarheid.

Annulatie door Refinavisión

Refinavisión behoudt zich het recht voor een reservatie te annuleren in geval van:

• overmacht
• onvoorziene omstandigheden
• situaties die de veiligheid of kwaliteit van het verblijf in het gedrang brengen

In dat geval wordt:

• een passend alternatief voorgesteld, of
• het betaalde bedrag terugbetaald (zonder bijkomende schadevergoeding)

7. Gebruik van de locatie

Om de kwaliteit, rust en veiligheid van het verblijf te waarborgen, gelden de volgende huisregels voor alle gasten en deelnemers:

• De locatie en accommodatie dienen steeds met zorg en respect behandeld te worden
• Het vooraf overeengekomen aantal gasten mag niet overschreden worden zonder toestemming
• Geluidsoverlast en storend gedrag zijn niet toegestaan, in respect voor de omgeving en eventuele omwonenden
• Roken is binnen niet toegestaan
• Alcoholgebruik dient steeds gematigd en respectvol te gebeuren; overmatig gebruik of storend gedrag wordt niet aanvaard
• Het gebruik van illegale verdovende middelen is niet toegestaan op het domein
• Het is niet toegestaan feesten of evenementen te organiseren zonder voorafgaande toestemming
• Afval dient correct gesorteerd en achtergelaten te worden volgens de instructies
• Schade aan de accommodatie, faciliteiten of omgeving dient onmiddellijk gemeld te worden
• Alle instructies met betrekking tot veiligheid en gebruik van de faciliteiten dienen gevolgd te worden

De klant (hoofdboeker) is verantwoordelijk voor het naleven van deze huisregels door alle deelnemers van de groep.

Niet‑naleving van deze huisregels kan leiden tot:

• bijkomende kosten
• aansprakelijkheid voor schade
• of in ernstige gevallen vroegtijdige beëindiging van het verblijf

8. Aansprakelijkheid

Refinavisión kan niet aansprakelijk gesteld worden voor:

• verlies, diefstal of beschadiging van persoonlijke eigendommen
• ongevallen, tenzij veroorzaakt door zware fout of nalatigheid
• externe activiteiten georganiseerd door derden

De klant blijft te allen tijde verantwoordelijk voor zijn eigen gedrag en dat van de deelnemers.

9. Deelname en verantwoordelijkheid

Deelname aan activiteiten en gebruik van de faciliteiten gebeurt op eigen verantwoordelijkheid.

De klant is verplicht om relevante informatie te delen die van belang kan zijn voor het verblijf, zoals:

• fysieke beperkingen
• dieetwensen of allergieën

Refinavisión streeft naar een veilige en aangepaste ervaring, maar kan niet aansprakelijk worden gesteld voor gevolgen van niet‑gedeelde informatie.

10. Overmacht

Refinavisión is niet aansprakelijk voor het niet naleven van haar verplichtingen in geval van overmacht.

Onder overmacht wordt onder meer verstaan:

• natuurrampen of extreme weersomstandigheden
• pandemieën of gezondheidscrisissen
• stakingen
• overheidsmaatregelen
• technische storingen

11. Privacy en gegevensbescherming

Refinavisión verwerkt persoonsgegevens in overeenstemming met de geldende regelgeving en zoals beschreven in het privacybeleid op de website.

12. Toepasselijk recht en geschillen

Op deze voorwaarden is Spaans recht van toepassing.

Geschillen worden bij voorkeur in onderling overleg opgelost. Indien nodig worden deze voorgelegd aan de bevoegde rechtbanken in Spanje.

13. Slotbepalingen

Indien één of meerdere bepalingen van deze voorwaarden ongeldig of niet afdwingbaar blijken, blijven de overige bepalingen volledig van kracht.

Refinavisión behoudt zich het recht voor deze voorwaarden te allen tijde aan te passen.

General terms and conditions

1. Company identification

Throughout these Terms and Conditions, Refinavision SL shall be referred to as “Refinavisión.”

2. Scope of application

These Terms and Conditions apply to all quotations, reservations, bookings, stays and services offered by Refinavisión.

By making a reservation, accepting a quotation or using our services, the customer agrees to these Terms and Conditions.

Any deviations from these Terms and Conditions shall only be valid if agreed upon in writing.

3. Offers and reservations

All quotations issued by Refinavisión are non-binding and based on the information available at the time.

An agreement is concluded when:

• the quotation has been confirmed in writing by the customer; and
• any deposit specified in the quotation has been received.

Refinavisión reserves the right to refuse a request without stating a reason.

4. Prices

All prices stated are:

• exclusive or inclusive of VAT, as indicated
• based on the costs applicable at that time.

Refinavisión reserves the right to adjust prices if external factors (such as energy costs, suppliers, inflation or legislation) make this necessary.

5. Payment

Unless otherwise agreed:

• A deposit of 50% is required upon confirmation of the booking
• The remaining balance must be paid 30 days prior to the start of the stay or programme.

Invoices must be paid within the stated payment period. In the event of late payment, Refinavisión reserves the right to cancel the reservation.

Additional charges

Any additional costs incurred during the stay or programme (such as extra consumptions, activities or services) will be invoiced separately after completion, unless otherwise agreed.

6. Cancellation and changes

Cancellation by the customer

Cancellation of a confirmed reservation must be submitted in writing.

In the event of cancellation of a confirmed reservation, the following conditions apply (unless otherwise agreed):

• Cancellation up to 30 days before arrival: 50% refund of the deposit
• Cancellation between 30 and 15 days before arrival: 50% refund of the amount paid
• Cancellation less than 15 days before arrival: no refund

Changes

Changes to reservations may be made upon request and are subject to availability.

Cancellation by Refinavisión

Refinavisión reserves the right to cancel a reservation in the event of:

• force majeure
• unforeseen circumstances
• situations that jeopardise the safety or quality of the stay

In such cases:

• a suitable alternative will be offered; or
• the amount paid will be refunded (without any additional compensation)

7. Use of the property

To ensure the quality, tranquillity and safety of the stay, the following house rules apply to all guests and participants:

• The property and accommodation must always be treated with care and respect
• The agreed number of guests may not be exceeded without prior permission
• Excessive noise and disruptive behaviour are not permitted, out of respect for the surroundings and any neighbours
• Smoking is not permitted indoors
• Alcohol consumption must always be moderate and respectful; excessive use or disruptive behaviour will not be tolerated
• The use of illegal drugs is not permitted anywhere on the property
• Parties or events may not be organised without prior approval
• Waste must be correctly sorted and disposed of in accordance with the provided instructions
• Any damage to the accommodation, facilities or surroundings must be reported immediately
• All instructions relating to safety and the use of facilities must be followed

The customer (lead booker) is responsible for ensuring that all participants in the group comply with these house rules.

Failure to comply with these rules may result in:

• additional charges
• liability for damages
• or, in serious cases, early termination of the stay.

8. Liability

Refinavisión cannot be held liable for:

• loss, theft or damage to personal belongings
• accidents, unless caused by gross negligence or serious misconduct
• external activities organised by third parties

The customer remains responsible at all times for their own conduct and that of the participants.

9. Participation and responsibility

Participation in activities and use of the facilities are at the participant’s own responsibility and risk.

The customer is required to provide relevant information that may be important for the stay, such as:

• physical limitations
• dietary requirements or allergies

Refinavisión strives to provide a safe and appropriate experience but cannot be held liable for consequences resulting from information that was not disclosed.

10. Force majeure

Refinavisión shall not be liable for failure to fulfil its obligations in cases of force majeure.

Force majeure includes, but is not limited to:

• natural disasters or extreme weather conditions
• pandemics or public health crises
• strikes
• government measures
• technical failures

11. Privacy and data protection

Refinavisión processes personal data in accordance with applicable legislation and as described in the Privacy Policy available on the website.

12. Governing law and disputes

These terms and conditions are governed by Spanish law.

Disputes shall preferably be resolved amicably between the parties. Where necessary, disputes shall be submitted to the competent courts in Spain.

13. Final Provisions

Should one or more provisions of these Terms and Conditions be found invalid or unenforceable, the remaining provisions shall remain fully in effect.

Refinavisión reserves the right to amend these Terms and Conditions at any time.

En las presentes condiciones generales, Refinavision SL será denominada en adelante como «Refinavisión».

2. Ámbito de aplicación

Las presentes condiciones generales son aplicables a todos los presupuestos, reservas, contrataciones, estancias y servicios ofrecidos por Refinavisión.

Al realizar una reserva, aceptar un presupuesto o utilizar nuestros servicios, el cliente declara aceptar estas condiciones.

Cualquier excepción o modificación de estas condiciones únicamente será válida si ha sido acordada por escrito.

3. Oferta y reserva

Todos los presupuestos emitidos por Refinavisión son sin compromiso y se basan en la información disponible en ese momento.

Se considerará formalizado un acuerdo cuando:

• el presupuesto haya sido confirmado por escrito por el cliente; y
• se haya recibido el eventual anticipo indicado en el presupuesto.

Refinavisión se reserva el derecho de rechazar cualquier solicitud sin necesidad de justificar su decisión.

4. Precios

Todos los precios indicados son:

• con o sin IVA, según se indique;
• basados en los costes vigentes en el momento de la oferta.

Refinavisión se reserva el derecho de modificar los precios si factores externos (como costes energéticos, proveedores, inflación o cambios legislativos) así lo requieren.

5. Pago

Salvo acuerdo en contrario:

• Se requerirá un anticipo del 50 % al confirmar la reserva;
• El importe restante deberá abonarse 30 días antes del inicio de la estancia o programa.

Las facturas deberán abonarse dentro del plazo indicado. En caso de impago o de pago fuera de plazo, Refinavisión se reserva el derecho de cancelar la reserva.

Costes adicionales

Los posibles gastos adicionales durante la estancia o el programa (como consumiciones, actividades o servicios adicionales) se facturarán por separado una vez finalizada la estancia, salvo que se haya acordado lo contrario.

6. Cancelaciones y modificaciones

Cancelación por parte del cliente

La cancelación de una reserva confirmada deberá comunicarse por escrito.

En caso de cancelación de una reserva confirmada, se aplicarán las siguientes condiciones (salvo acuerdo expreso en contrario):

• Cancelación hasta 30 días antes de la llegada: reembolso del 50 % del anticipo.
• Cancelación entre 30 y 15 días antes de la llegada: reembolso del 50 % del importe abonado.
• Cancelación con menos de 15 días de antelación a la llegada: no habrá reembolso.

Modificaciones

Las modificaciones de reservas podrán realizarse previa solicitud y estarán sujetas a disponibilidad.

Cancelación por parte de Refinavisión

Refinavisión se reserva el derecho de cancelar una reserva en caso de:

• fuerza mayor
• circunstancias imprevistas
• situaciones que comprometan la seguridad o la calidad de la estancia

En tal caso:

• se propondrá una alternativa adecuada; o
• se devolverá el importe abonado (sin derecho a indemnización adicional)

7. Uso de las instalaciones

Para garantizar la calidad, tranquilidad y seguridad de la estancia, las siguientes normas internas serán aplicables a todos los huéspedes y participantes:

• Las instalaciones y el alojamiento deberán ser tratados en todo momento con cuidado y respeto.
• No podrá superarse el número de huéspedes previamente acordado sin autorización.
• No se permiten ruidos excesivos ni comportamientos molestos, por respeto al entorno y a los vecinos.
• Está prohibido fumar en el interior de las instalaciones.
• El consumo de alcohol deberá realizarse de forma moderada y respetuosa; no se tolerarán excesos ni comportamientos inapropiados.
• Está prohibido el consumo de drogas ilegales en toda la propiedad.
• No está permitido organizar fiestas o eventos sin autorización previa.
• Los residuos deberán separarse y depositarse correctamente siguiendo las instrucciones facilitadas.
• Cualquier daño en el alojamiento, las instalaciones o el entorno deberá comunicarse inmediatamente.
• Deberán respetarse todas las instrucciones relativas a la seguridad y al uso de las instalaciones

El cliente (responsable de la reserva) será responsable de que todos los participantes del grupo cumplan estas normas.

El incumplimiento de estas normas podrá dar lugar a:

• costes adicionales
• cesponsabilidad por daños y perjuicios
• o, en casos graves, la finalización anticipada de la estancia

8. Responsabilidad

Refinavisión no podrá ser considerada responsable de:

• la pérdida, robo o deterioro de pertenencias personales
• accidentes, salvo que hayan sido causados por negligencia grave o conducta dolosa
• actividades externas organizadas por terceros

El cliente seguirá siendo responsable en todo momento de su propio comportamiento y del de los participantes.

9. Participación y responsabilidad

La participación en actividades y el uso de las instalaciones se realizan bajo la propia responsabilidad y riesgo de cada participante.

El cliente está obligado a comunicar cualquier información relevante que pueda ser importante para la estancia, como:

• limitaciones físicas
• necesidades alimentarias o alergias

Refinavisión se esfuerza por ofrecer una experiencia segura y adaptada, pero no podrá ser considerada responsable de las consecuencias derivadas de información que no haya sido comunicada.

10. Fuerza mayor

Refinavisión no será responsable del incumplimiento de sus obligaciones cuando dicho incumplimiento sea consecuencia de una situación de fuerza mayor.

Se considerarán, entre otros, supuestos de fuerza mayor:

• catástrofes naturales o condiciones meteorológicas extremas
• pandemias o crisis sanitarias
• huelgas
• medidas gubernamentales
• fallos técnicos

11. Privacidad y protección de datos

Refinavisión trata los datos personales de conformidad con la normativa vigente y según lo descrito en la Política de Privacidad disponible en el sitio web.

12. Legislación aplicable y resolución de conflictos

Las presentes condiciones se rigen por la legislación española.

Las partes procurarán resolver cualquier conflicto de forma amistosa. En caso de no ser posible, la controversia se someterá a los tribunales competentes de España.

13. Disposiciones finales

Si una o varias disposiciones de estas condiciones fueran declaradas inválidas o inaplicables, las demás disposiciones continuarán siendo plenamente vigentes.

Refinavisión se reserva el derecho de modificar estas condiciones en cualquier momento.
